Law360 (February 15, 2023, 6:40 PM EST) — Blue Cross Blue Shield members asked an Alabama federal judge to cull time-barred claims from a major antitrust lawsuit by Bed Bath & Beyond and other corporations, while several members of the insurance network asked to evade altogether a lawsuit they said cannot tie them to the state.
The lawsuit is one of several from corporations who opted out of a $2.67 billion class action settlement over multidistrict litigation allegations that the BCBS model illegally carves up the national insurance market and keeps prices high by prohibiting competition across specified zones. The suit cannot seek damages from injuries predating early November 2016, the Blues network said in a motion to dismiss Tuesday.
