Law360 (January 20, 2023, 8:09 PM EST) — A Pennsylvania Blue Cross Blue Shield licensee asked a Pennsylvania federal judge to find that it is owed coverage from its excess errors and omissions insurer for antitrust litigation it is facing, part of which has been settled for $2.67 billion.
Capital BlueCross alleged in an amended suit Friday that Atlantic Specialty Insurance Co. refused to consent to the settlement agreement reached in 2020 by subscribers suing various BCBS units.
Capital BlueCross also alleged that Atlantic Specialty has declined coverage for ongoing litigation against BCBS units from health care providers.
