Law360 (October 5, 2022, 6:40 PM EDT) — The Eleventh Circuit should consolidate and expedite four overlapping appeals filed by a small subgroup of subscribers challenging an Alabama federal court’s approval of a $2.67 billion class award settlement in multidistrict litigation against Blue Cross Blue Shield insurers, a group of pro-settlement subscribers told the court Wednesday.
The appeals, all filed Sept. 9, shouldn’t slow down the distribution of settlement funds or the implementation of injunctive relief aimed at promoting competition in the national health care marketplace, a group representing the majority of the subscriber class told the appellate court in an emergency motion.
Three businesses, including Home Depot USA Inc., and three individuals have filed the appeals but have not yet submitted opening briefs detailing what aspects of the settlement they take issue with.
